Welcome to a quiet counter. These Terms of Service ("Terms") govern your access to and use of the a quiet counter progressive web application, native applications, and related services (collectively, the "Service"), operated by Juniper Post Pty Ltd (ABN 89 684 236 342) ("Company," "we," "us"). "a quiet counter" is a registered business name of Juniper Post Pty Ltd. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to create an account and use the Service. By registering, you represent that you meet this requirement. We do not knowingly collect data from anyone under 16. If we learn that a user is under 16, we will delete their account and data.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

2. AI Features, Automated Classification, and Allergen Warning

All classifications, nutritional estimates, and dietary tags produced by a quiet counter are entirely automated and subject to error. Do not rely on them to manage food allergies or medical conditions.

a quiet counter uses automated heuristics and artificial intelligence (including Google Gemini and Google Cloud Vision) to transcribe voice notes, extract recipes from video URLs, tag cuisines, estimate macro-nutritional data, and classify recipes into dietary profiles (e.g., Vegetarian, Vegan).

Nutrition figures, dietary tags, freshness indicators, and meal suggestions are automated estimates and may be inaccurate. Nothing in the Service is medical, dietary, or nutritional advice. Always consult a qualified professional before making decisions about your health, diet, or any medical condition.

3. Food Safety, Stock Tracking, and Expiry Dates

The freshness indicators in the Kitchen Pulse / Stock view (such as "fresh," "use soon," "defrost," or "use today") are algorithmic estimates based on user-inputted dates, standard assumptions, and your weekly planning schedule. They are not biological sensors. The Company disclaims all liability for foodborne illness, spoilage, or adverse health reactions. Always apply your own sensory judgment and follow local food safety guidelines.

4. Intellectual Property, User Content, and Copyright Safe Harbour

All recipe import, parsing, and data-input tools are designed exclusively for building a private, non-commercial, personal Recipe Library.

5. Subscriptions and Billing

Certain premium features ("a quiet counter Plus") require a paid subscription. Subscriptions are processed by RevenueCat via the Apple App Store, Google Play Store, or our web billing provider. Current pricing (USD, inclusive of applicable taxes):

Free trial: New subscribers receive a 7-day free trial. Any unused portion of a free trial period will be forfeited if you purchase a subscription before the trial ends. Prices are listed in USD; your local price may vary by region and is shown before you confirm a purchase.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Payment is charged to your Apple ID or Google Play account at confirmation of purchase and at the start of each renewal period.

Managing or cancelling: To cancel or manage your subscription, go to your device's Account Settings after purchase. Cancelling stops future charges but does not entitle you to a refund of the current period. After cancellation, Plus features remain accessible until the end of the paid period, after which your account reverts to the free tier and access to premium features (including historical nutrition records, advanced AI imports, and Auto-Menu) may be restricted.

Service caps: Plus features are subject to monthly server-side usage limits per account (e.g., video imports: 30; meal photo analyses: 100; voice recipe imports: 20; barcode/product searches: 100; OCR cleanups: 100; in-app recipe searches: 100). These limits exist to ensure platform stability and prevent misuse. Unused allowances do not roll over. The Company reserves the right to adjust limits with reasonable notice.

A/B testing: By using the Service, you acknowledge that you may be subject to automated experiments (e.g., variable trial lengths, feature rollouts) designed to improve the Service.

6. Shared Household Accounts

When you link accounts via a Household share code, you consent to a joint, synchronised data environment where all linked users can view, modify, or permanently delete shared recipes and weekly plans. If the Household connection is revoked or dissolved, the Company will make a commercially reasonable effort to allow departing members to export a copy of shared recipes. However, the Company does not guarantee data preservation, and you agree we are not liable for any data loss resulting from another household member's actions.

7. De-Identified Data Aggregation and Commercialisation

The Company collects behavioural and operational data about how you use the Service (e.g., ingredient selections, grocery list compositions, scheduling patterns). By using the Service, you grant the Company a perpetual, irrevocable, worldwide, royalty-free licence to de-identify, anonymise, and aggregate this data. You explicitly authorise us to licence or sell these anonymised datasets to third parties (such as food manufacturers and market researchers) for consumer trend analysis. We warrant that any data used for commercial purposes is structurally stripped of all Personal Identifying Information (PII) and cannot be reverse-engineered to identify you or your household.

8. Content Moderation and Availability

The Company may, at its sole discretion and without notice, remove, hide, restrict, or refuse to distribute any content (including creator content, published schedules, recipes, and collections), suspend or revoke any access code, and modify or discontinue any feature or the entire Service.

Creator content may be moderated, delisted, or removed at any time. The availability of any creator content is not guaranteed and may change or disappear. The Company is not obligated to retain, back up, or restore any content that is removed, and is not liable for any loss resulting from such removal or from the suspension or revocation of access codes.

9. Disclaimer of Warranties and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.

To the maximum extent permitted by applicable law, the Company's total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD $10. The Company is not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill.

10. Changes to the Service and Termination

The Company reserves the right to modify, suspend, or permanently discontinue the Service or any feature at any time, with or without notice. We may also terminate or suspend your account for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time via Profile → Account settings.

If we make material changes to these Terms, we will notify you via an in-app notice and update the "Last Updated" date above. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Queensland, Australia for any dispute arising out of or relating to these Terms or the Service.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot be lawfully excluded or limited.

12. Creator and Brand Metrics

Metrics shown to Partner Creators and brands, including Keeper Rate, Plates, Counter Score, and any benchmark or index comparison, are aggregated, estimated, and directional. They are not audited, not guaranteed to be accurate or complete, and should not be relied on as the sole basis for a business decision.

a quiet counter provides Partner Creators and brands with aggregate statistics derived from household usage of published recipes, including cooking and Cook Mode step data on creator-published recipes. These statistics exist to help creators improve their recipes and to help brands understand how a partnership performs in real kitchens. They are computed from real interaction events but are smoothed, estimated, or index-compared against a category baseline in ways that make them directional signals of engagement, not precise or auditable counts. We do not guarantee the accuracy, completeness, or continued availability of any metric, dashboard, or exported report. Metrics below our minimum reporting threshold (approximately 25 households) are withheld rather than shown, which means recently published or lower-reach recipes may show incomplete data through no fault of the recipe.
